Les experts n’ont pas l’obligation de convoquer les parties au procès, mais ils peuvent convoquer, entendre et recevoir les déclarations de personnes autres que l’inculpé souvent désignées sous le nom de sachants pour ce qui est nécessaire à l’accomplissement de leur mission, et parmi ces personnes doit être comprise la partie civile. L’expert ne peut interroger l’inculpé qu’à la condition de recevoir à cet effet une délégation motivée et délivrée à titre exceptionnel par le juge ou bien dans le cas où l’inculpé a renoncé par déclaration expresse au bénéfice de cette disposition. L’expertise en matière administrative
Le tribunal administratif peut, lui aussi, recourir à une mesure d’expertise ; il peut, soit d’office, soit à la demande des parties ou de l’une d’elles, ordonner, avant faire droit, qu’il, sera procédé à une expertise sur les points déterminés par sa décision ; en cas d’urgence, le président du tribunal, ou le conseiller qu’il délègue, peut, sur simple requête présentée avec ou sans ministère d’avocat, désigner un expert. Rôle du service de l’Exploitation
Le service de l’Exploitation apparaît dans le chemin de fer dès la création de lignes destinées à des transports publics. Les chemins de fer ont développé de nombreux dispositifs assurant la sécurité et la régularité des trains. Les progrès réalisés par le matériel moteur et remorqué ont amélioré la régularité des circulations. Pour le service des voyageurs, les chemins de fer développent actuellement les procédés automatiques d’établissement des billets et de réservation des places grâce à l’emploi d’ordinateurs.
